Terms of Service

These terms are a contract between you and DeepAPI. By creating an account, joining the waitlist, signing in, or using the API, you agree to them. If you use DeepAPI on behalf of a company, you agree on its behalf too.

1. Who we are

DeepAPI is operated by DADA INDUSTRIES sp. z o.o. ("DeepAPI", "we", "us"). DeepAPI gives AI agents one API key for capabilities like public web data extraction, web search, research, image generation, and email. The Data Processing Addendum is incorporated into these terms by reference.

2. Early access — this is a beta

DeepAPI is in early access. The service is unfinished and changes often. Features may change, break, or be removed at any time. Results may be wrong, incomplete, or delayed. We may pause or end the beta, or your access to it, at any time. Do not rely on the beta for anything critical, and keep your own copies of anything important: stored data may be modified or lost.

3. Your account

Keep your sign-in details and API keys secret. Everything done with your account or your keys counts as done by you, and you are responsible for it. Tell us right away at support@deepapi.co if you think a key or account was compromised.

4. Installer and local setup

If you run our installer or any setup command we provide, you authorize DeepAPI to install, configure, and update software on that machine. That may include storing credentials locally, configuring your environment and compatible agents, extending system prompts, and running a small verification request billed as ordinary usage. You are responsible for the machine and for any local changes. Running the installer means you accept this.

5. Acceptable use

These rules keep DeepAPI safe to operate for everyone. If you break them, we can suspend or terminate your access immediately.

Lawful use only. Use DeepAPI only for lawful purposes. You must comply with all laws that apply to you — including privacy, data protection, anti-spam, intellectual property, and computer misuse laws — and with any third-party terms that bind you.

Web data rules. DeepAPI reads only publicly available web pages, without logging in. You must not use the service, or combine it with anything else, to:

  • access data behind a login, paywall, or other access control, or submit credentials, session cookies, or authentication tokens for any third-party site;
  • create or use fake accounts or misrepresent your identity to any platform;
  • bypass or attempt to bypass technical protection measures such as CAPTCHAs, login walls, IP blocks, or anti-bot systems;
  • collect data about people to stalk, harass, dox, discriminate against, or surveil them;
  • resell raw personal data obtained through DeepAPI as a data product, or use it in ways privacy law forbids.

Email rules. Email through DeepAPI must be wanted mail. You must not send:

  • spam or bulk unsolicited email of any kind — commercial or not;
  • email to recipients who have not consented or who have opted out;
  • phishing, deceptive sender information, misleading subject lines, malware, or scams.

You are the sender of every email your agents send, with all legal duties that carries (for example under CAN-SPAM and GDPR).

Platform integrity.

  • No probing, scanning, or attacking DeepAPI itself.
  • No sharing API keys with third parties to evade limits.
  • No use that imposes unreasonable load or interferes with other customers.

Enforcement. We may investigate suspected violations and may suspend or terminate any account, key, capability, or data source at our sole discretion, with or without notice. We may remove any hosted page or disable any data source entirely — for example after a legal complaint. Report abuse to support@deepapi.co.

6. Your responsibility for what you do with the service

You decide what to request through DeepAPI and what to do with the results. You are solely responsible for your use, including which websites you ask us to read, what data you collect, how you store and share it, and every email you send. You must comply with all laws that apply to you (including privacy and anti-spam laws) and with any third-party terms that bind you. We do not review your requests for legality and are not your lawyer.

7. Credits, fees, and pricing

Usage is paid with prepaid credits. Prices are shown in the dashboard and may change; we will give notice of price changes, and they apply to usage after the change. Credits have no cash value, are not transferable, and are non-refundable except where the law requires a refund. You are responsible for usage charges run up by your agents and keys, including buggy or runaway agents — use spend limits.

Automatic top-ups. If you enable automatic top-ups and save a payment method, you authorize DeepAPI to charge that method without further approval whenever your credit balance falls below the threshold you choose. Each charge will be the refill amount shown in your settings, plus any applicable tax. For a temporary failure, we may retry once about six hours later and once more about 24 hours after the first failure; we do not retry hard declines or payments requiring authentication. You can change the threshold or refill amount, replace your payment method, or disable automatic top-ups at any time on the Credits page. Disabling stops future automatic charges but does not reverse a charge already submitted.

8. Suspension and termination

We may suspend or terminate any account, API key, capability, or data source at any time, at our sole discretion, with or without notice — for example for a breach of these terms, legal risk, abuse, non-payment, or because we discontinue part of the service. You may stop using DeepAPI at any time. Sections 6 and 10–14 survive termination.

9. Changes to the service, pricing, and these terms

We may modify the service, pricing, and these terms. When we make material changes to these terms we will give notice (for example by email or in the dashboard) and update the date above. Using DeepAPI after a change means you accept the changed terms. If you do not accept them, stop using the service.

10. No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. THIRD-PARTY DATA AND AI-GENERATED OUTPUT MAY BE WRONG. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limit on our liability

TO THE MAXIMUM EXTENT THE LAW ALLOWS: WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS TOGETHER IS CAPPED AT THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) 100 US DOLLARS. THIS CAP APPLIES TO EVERY KIND OF CLAIM, WHETHER IN CONTRACT, TORT, OR OTHERWISE.

12. You indemnify us for your use

You will defend, indemnify, and hold harmless DeepAPI and its owners, employees, and contractors from any claim, demand, damage, fine, or expense (including reasonable legal fees) arising from your use of the service, including data you collect through it, websites or platforms affected by your requests, emails you send through it, your violation of these terms, or your violation of any law or third-party right.

13. Governing law

These terms are governed by the law of Poland, and its courts have exclusive jurisdiction over disputes, without regard to conflict of law rules.

14. Severability

If a provision of these terms is held unenforceable, it is limited or removed to the minimum extent necessary. The rest of these terms stay in force.
